Service Agreement

Fenuva PMS Service Agreement

Effective Date: June 2026

This Service Agreement ("Agreement") is entered into between Mygraphics Online ("Mygraphics Online", "Company", "we", "our", or "us"), the owner and operator of the Fenuva PMS platform, and the customer ("Customer", "you", or "your") subscribing to or using the Services.

Fenuva PMS is a cloud-based Property Management System (PMS) software platform developed and operated by Mygraphics Online for hotels, resorts, guesthouses, serviced apartments, and other hospitality businesses.


The Services include the Fenuva PMS web application, mobile application, APIs, cloud infrastructure, and all related services provided by Mygraphics Online.

By creating an account, accessing, or using the Fenuva PMS Services, you agree to be bound by this Agreement.

1. Services

Fenuva PMS provides a cloud-based Property Management System (PMS), including:

  • Web Application
  • Mobile Application
  • Cloud Hosting
  • Reservation Management
  • Booking Calendar
  • Guest Management
  • Folio & Invoice Management
  • Housekeeping
  • Reports & Analytics
  • Team Communication
  • APIs and Integrations
  • Future modules and updates released by Fenuva

The Services are provided as Software as a Service (SaaS).

2. Customer Account

Each subscribing property receives its own secure environment.

Each property is responsible for:

  • Creating user accounts
  • Assigning permissions
  • Maintaining secure passwords
  • Protecting access credentials

Customers are responsible for all activities performed through their accounts.

3. Mobile Application Connection

The Fenuva PMS mobile application connects only to authorized Fenuva PMS property environments.

Connection may be established by:

  • Scanning a QR Code generated from the property's web application; or
  • Entering the property server URL manually.

The Customer is responsible for ensuring only authorized users have access.

4. Subscription

Access to Fenuva PMS requires an active subscription unless otherwise agreed in writing.

Subscription plans may include different features and limits.

Failure to maintain an active subscription may result in suspension or termination of Services.

5. Customer Responsibilities

The Customer agrees to:

  • Use the Services lawfully.
  • Maintain accurate information.
  • Protect login credentials.
  • Ensure users comply with this Agreement.
  • Maintain internet connectivity and compatible devices.

6. Data Ownership

All business data entered into the Services remains the property of the Customer.

This includes:

  • Reservations
  • Guest Profiles
  • Invoices
  • Folios
  • Reports
  • Housekeeping Records
  • Operational Data
  • Uploaded Files

Fenuva does not claim ownership of Customer data.

7. Data Processing

Fenuva processes Customer data solely for the purpose of providing the Services.

Customer data may be stored securely in cloud infrastructure located in jurisdictions selected by Fenuva or its infrastructure providers.

8. Security

Fenuva implements commercially reasonable technical and organizational security measures including:

  • Encrypted communications (HTTPS/TLS)
  • Authentication controls
  • Access permissions
  • Regular backups
  • Infrastructure monitoring

No internet-based service can guarantee absolute security.

9. Availability

Fenuva aims to provide high service availability.

Temporary interruptions may occur due to:

  • Maintenance
  • Infrastructure upgrades
  • Third-party outages
  • Internet failures
  • Force majeure events

10. Updates

Fenuva may:

  • Release new features
  • Modify existing features
  • Fix software defects
  • Improve security
  • Improve performance

Updates may occur without prior notice where necessary.

11. Third-Party Services

The Services may integrate with third-party platforms including payment providers, email services, messaging services, cloud hosting providers, or other integrations.

Use of third-party services is subject to the respective third-party terms.

12. Intellectual Property

Fenuva retains all intellectual property rights relating to:

  • Software
  • Source code
  • User interface
  • APIs
  • Documentation
  • Branding
  • Logos
  • Trademarks

Customers receive a limited, non-exclusive, non-transferable license to use the Services during an active subscription.

13. Prohibited Activities

Customers shall not:

  • Reverse engineer the Services.
  • Copy or redistribute the software.
  • Circumvent security mechanisms.
  • Upload malware or malicious code.
  • Use the Services for unlawful purposes.
  • Attempt unauthorized access to any other customer's environment.

14. Fees and Payments

Subscription fees are payable according to the selected plan.

Failure to pay may result in suspension or termination of Services.

Unless otherwise required by law, fees are non-refundable.

15. Suspension and Termination

Fenuva may suspend or terminate access if:

  • Subscription fees remain unpaid.
  • This Agreement is violated.
  • Use of the Services poses a security risk.
  • Required by law.

Customers may terminate their subscription according to their subscription terms.

16. Limitation of Liability

To the maximum extent permitted by law, Fenuva shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business interruption, or loss of data.

Fenuva's total liability under this Agreement shall not exceed the subscription fees paid by the Customer during the twelve (12) months preceding the event giving rise to the claim.

17. Indemnification

The Customer agrees to indemnify and hold harmless Fenuva from claims, damages, losses, and expenses arising from:

  • Customer's misuse of the Services.
  • Violation of this Agreement.
  • Violation of applicable laws.

18. Confidentiality

Each party shall protect confidential information received from the other and use it only for purposes related to this Agreement.

19. Privacy

Use of the Services is also governed by the Fenuva PMS Privacy Policy.

20. Changes to this Agreement

Fenuva may update this Agreement from time to time.

Updated versions become effective upon publication on the Fenuva website or within the Services.

Continued use of the Services constitutes acceptance of the updated Agreement.

21. Governing Law

This Agreement shall be governed by the laws applicable to the jurisdiction in which the contractual relationship is established, unless otherwise agreed in writing.
